Montana Business Guide

Launching a Business and Website in Montana: The Complete Digital Setup Guide

Montana has no state sales tax, a $20 annual report fee, and the country's newest privacy law went into effect in 2024. With Bozeman becoming one of the fastest-growing tech-and-outdoors metros in the West, the state has quietly become a real launchpad for outdoor brands, software companies, and remote-first founders.

Montana mixes small-town pace with surprising depth: Bozeman's tech and outdoor cluster has produced multiple unicorn-scale companies; Missoula and Helena anchor stable professional-services markets; the Bakken and Powder River basins drive resource industries; and Yellowstone and Glacier National Park anchor a serious year-round tourism economy. Filing fees are low, there's no statewide sales tax, and the Montana Consumer Data Privacy Act adds new website obligations in 2024.

Part 1 — Legal Business Registration Steps in Montana

Montana business formations are filed with the Montana Secretary of State, Business Services Division via the ePass Montana portal at sosmt.gov.

File your formation documents

  • Domestic LLC Articles of Organization: filing fee is currently $35 — among the lowest in the country.
  • Domestic for-profit corporation Articles of Incorporation: filing fee is currently $35 — verify on the SOS fee schedule.
  • Registered agent: Required.

Annual Report — Montana's $20 every-year filing

Every Montana LLC and corporation must file an Annual Report with the Secretary of State each year. The filing fee is currently $20. Reports are due by April 15 each year. Late filing brings a $15 penalty after April 15.

Verify before filing. Confirm current fees at sosmt.gov before paying.

No statewide sales tax (with limited resort exceptions)

Montana is one of the very few states with no statewide general sales tax. Limited "resort tax" jurisdictions (Big Sky, Whitefish, West Yellowstone, Red Lodge, and select others) levy local sales taxes on certain goods and services to fund tourism infrastructure. Online sellers shipping to Montana customers generally do not need to collect sales tax for in-state delivery.

Local licensing

Most Montana cities (Billings, Missoula, Bozeman, Helena, Great Falls) require local business licenses or registrations.

Part 2 — Montana Web Compliance: MCDPA, ADA, and More

Montana Consumer Data Privacy Act (MCDPA)

Montana enacted the Montana Consumer Data Privacy Act in 2023, with the substantive obligations taking effect October 1, 2024. The MCDPA applies to persons conducting business in Montana or producing products/services targeted to Montana residents and meeting either of the following:

  • Control or process the personal data of 50,000 or more Montana consumers annually (excluding data processed solely to complete a payment transaction); or
  • Control or process the personal data of 25,000 or more Montana consumers and derive over 25% of gross revenue from the sale of personal data.

Montana's thresholds are lower than most peer states — and given Montana's small population, that means many more out-of-state businesses are pulled into scope based on small absolute volumes of Montana residents. Obligations track the standard pattern: privacy notice, consumer rights, opt-out signals (including UOOM/GPC), sensitive-data opt-in, and DPIAs. Enforcement is by the Montana Attorney General with a 60-day cure period sunsetting in 2026.

Website accessibility

Title III of the ADA applies. Montana is a low-volume ADA-website-lawsuit jurisdiction. Build to WCAG 2.1 Level AA.

Not legal advice. Confirm specifics with a Montana-licensed attorney before publishing.

Part 3 — Strategic Web Design for Montana Industries

Montana's economy concentrates around tourism, outdoor recreation, and lodging (Yellowstone, Glacier, Big Sky resort destinations), agriculture and food/beverage (cattle, wheat, craft beverage), and a growing technology and remote-work cluster centered in Bozeman (Onx, Submittable, Workiva-affiliated and others). Mining, energy, and timber round out the resource side.

Tourism, lodging, outfitters

For Montana lodges, outfitters, dude ranches, and tour operators, aThemes Sydney's hospitality starter sites include photo-led layouts and booking integrations on a 90+ PageSpeed codebase.

Outdoor brands and Montana-made product

  • Montana Manufacturing Extension Center (MMEC): Federally funded technical assistance for Montana manufacturers, including digital and e-commerce adoption.

  • Local economic-development programs: Bozeman Area Chamber of Commerce, Missoula Economic Partnership, Billings Chamber.

  • Implement LocalBusiness or TouristAttraction schema with proper sub-type and areaServed.
  • Target town and region-level intent. Visitors search "fly fishing guide Bozeman," "lodge Big Sky," "guided hike Glacier National Park."
  • Build seasonal content around fishing seasons, ski seasons, summer hiking, fall hunting.
  • Earn reviews from out-of-state visitors immediately after their trip.
